Driver Killed, Passenger Injured in Crash on State Route 78
SAN MARCOS (December 19, 2017)- According to CBS 8 News, a deadly collision was reported Monday evening on Ronald Packard Parkway also referred to as Highway 78.
California Highway Patrol officials responded to the scene of a crash involving two vehicles at 7:35 p.m. near Nordahl Road.
Authorities have disclosed that the driver of a pickup truck had been headed westbound when for unknown reasons he drifted over to the right-hand shoulder and struck the rear of an unoccupied disabled vehicle with its lights on waiting for roadside assistance.
Per CBS 8 News, the driver of the pickup did not survive the impact of the collision as he was pronounced at the scene. He is only being ID’d as a 27-year-old male for now.
Meanwhile, the passenger of the pickup truck who has not been ID’d by name or age, sustained moderate to serious injuries and was transported by ambulance to a local area hospital.
Authorities are currently looking into whether the driver was under the influence or distracted as preliminary investigative efforts indicate that it was unlikely that brakes were applied prior to the crash.
Fortunately, the operator of the disabled vehicle was unharmed, according to the report.
Two lanes on Ronald Packard Parkway were temporarily shut down for an extended period of time as was Nordahl Road.

Based on the information provided within the article, the driver of the vehicle who sadly passed away from the collision will be held responsible for causing the crash and will also be held liable for the injuries incurred by the passenger. Authorities will thoroughly investigate how fast the driver was going, whether or not alcohol or drugs were involved, and whether or not there were any mechanical issues with the vehicle. The investigation will also consist of looking at measurements of evidence left by the vehicle such as point of impact, final resting positions of each vehicle, skid marks, and gouge marks.
In such cases where negligence or wrongdoing may have been a factor, those injured and not found responsible for the crash may be granted the right to file a personal injury lawsuit against the at-fault party pending the investigation results. Victims would then have the right to seek compensation for damages including medical expenses and hospital bills, pain and suffering, and lost future income.
