Amanda Mayberry Paradise Bicycle Accident Elliot Road and Almond Street

PARADISE: Fatal Bicycle Accident Elliott Road, Almond Street (Jan. 12)Woman, 40, Fatally Struck by 2 Vehicles

PARADISE, Calif. (Jan. 16, 2018)- A bicyclist identified as Amanda Mayberry, 40, was fatally injured Friday evening following a tragic collision.

Authorities report the collision occurred at precisely 7:08 p.m. at the intersection of Elliot Road and Almond Street.

Per the article, Amanda Mayberry who was a resident of Paradise was rear-ended by a vehicle and thrown into the path of the second car at Elliott Road and Almond Street, according to Paradise police.

The victim, Amanda Mayberry, had been riding her bicycle eastbound before being rear-ended on Elliot Road by Donna Mikel, 70. After being ejected from her bicycle, Mayberry landed in front of a westbound motorist identified as Jessica Raschka, 21.

The 40-year-old woman who was a resident of Paradise was then pinned underneath Raschka’s vehicle and was sadly pronounced dead at the arrival of paramedics.

Neither Raschka or Mikel were injured.

The Paradise Police Department is handling the investigation.

We offer our warmest of thoughts, our prayers, and condolences to the family members of Ms. Amanda Mayberry, as they search for peace and comfort.

Based on this news report, it appears that the 70-year-old driver of the involved vehicle will likely be held liable for the collision leading to the untimely passing of the victim. There are still several unanswered questions here. Was the driver under the influence of alcohol or drugs? Did excessive speed or distracted driving play a role? Was the driver negligent in any other way? We trust officials are looking into these and other factors in order to determine precisely what occurred here and why.

In such cases where negligence or wrongdoing may have been a factor, the family of the woman, Amanda Mayberry, will likely be entitled to a wrongful death lawsuit against the at-fault motorist pending the results of the investigation. Surviving immediate family members may seek compensation for damages including medical expenses and hospital bills, funeral costs, lost future income, pain and suffering, and loss of love and companionship.

The first thing you should do is contact an attorney. Without the representation of a lawyer, insurance companies might make contact with you directly, and since they are trained to protect their best interests, this could mean a loss of rights on your behalf, especially if you unknowingly sign something that they didn't completely explain to you. Handling a personal injury claim by yourself is very difficult. You will deal directly with the insurance adjuster who is often trained to obtain the information they are not entitled to use. This information can negatively impact and de-value your case. Once your case is damaged, it is very difficult to repair it and usually costs you thousands of dollars less in a settlement.
