Porterville Wrongful Death and Personal Injury Lawyer
A forensic examination of both the Honda and the tow truck, as well as photos that were taken of the scene, will help investigators determine which party ultimately caused the accident. Authorities will thoroughly look into how fast each driver was going, which driver had the right-of-way, whether or not alcohol or drugs were involved, and whether or not there were any mechanical issues with either vehicle. The investigation will also consist of looking at measurements of evidence left by each vehicle such as point of impact, final resting positions of each vehicle, skid marks, and gouge marks.
In such cases where negligence or wrongdoing may have been a factor, the family of Amparo Martinez, as well as Jose Martinez, will have the right to pursue a wrongful death and personal injury lawsuit respectively against tow truck driver if found liable. Wrongful death and injured accident victims may seek recompense for damages including funeral costs, loss of companionship, medical expenses, hospital bills, and pain and suffering.
