A forensic examination of both the vehicle and the pedestrian victim, as well as photos that were taken of the scene, will help investigators determine which party ultimately caused the accident. Other potential factors will be looked into as well including whether or not either the driver or the bicyclist were under the influence at the time of the accident? Was the driver driving recklessly or over the speed limit prior to impact? Was the pedestrian victim in a crosswalk or a designated crossing area? Was she jaywalking? What were the road conditions and how was the lighting in the vicinity of where the accident occurred? Each of these factors will be assessed allowing police officials to draw up a final conclusion.
In such cases where negligence or wrongdoing may have been a factor, injured victims who are not held responsible for an accident may file a personal lawsuit against the at-fault party. Depending on the conclusion of the police report, if the bus driver is found even 1% liable, the injured victim may seek compensation for damages including medical expenses and hospital bills, pain and suffering, and lost future income due to absence from work.
