Based on the details provided so far from the report, it seems as though the driver may likely at least share some responsibility for the collision as it is believed the victim may have been within the means of a marked crosswalk upon being struck. There are still many unanswered questions, however, under California law, drivers who are approaching a pedestrian are required to exercise due care and reduce their speed for the safety of the pedestrian.
In such cases where negligence or wrongdoing is clearly a factor, the surviving family of Jason Ortega will be entitled to a wrongful death lawsuit against the suspect. Family members of wrongful death victims are entitled to a recompense for damages including hospital bills, funeral costs, loss of future income and loss of love and companionship.
