DATE OF ACCIDENT: Saturday, September 22nd
September 24, 2018 – A 34-year-old man was injured in a pedestrian accident on South 9th Street early Saturday, according to the Modesto Bee.
Preliminary investigation revealed Deputy Derek Crowley was driving a Stanislaus County sheriff deputy’s patrol vehicle south on South 9th Street near Pecos Avenue. Then, at about 1 a.m., two pedestrians reportedly walked into the street, and Crowley was unable to stop on time to avoid collision.
As per the article, the deputy braked and turned his vehicle to the right, avoiding one of the pedestrians but hitting the second. That second pedestrian was reportedly rushed to Doctors Medical Center for treatment of what appeared to be major injuries.
Officials identified the patient as Alvin Estrada.
At this time, it is still unknown how fast Crowley was driving when the accident took place. Detectives handling the case continue to work to determine precisely what happened here and why.

Based on the details provided so far from the report, there are still many unanswered questions. Under California law, drivers who are approaching a pedestrian are required to exercise due care and reduce their speed for the safety of the pedestrian. A forensic examination, however, of both the vehicle and the victim, as well as photos that were taken of the scene, will help investigators determine what transpired. This will help investigators determine which party ultimately caused the accident. The preliminary investigation has revealed that the driver was not under the influence of drugs and or alcohol, police said. Other factors to consider, was the driver distracted, operating the vehicle recklessly, or traveling over the speed limit prior to impact? Police will ultimately determine fault for this accident and issue a report.
Depending on the results of the investigation, Mr. Alvin Estrada may have the right to a personal injury claim. Victims in pedestrian accidents would potentially be entitled to seek compensation for hospital bills, future medical expenses, and pain and suffering.
