In this case, there are several questions that need to be resolved in order to determine the liability in the collision. Was the driving under the influence of alcohol or drugs a factor? Did excessive speed or distracted driving play a role? Who had the right of way? Did the driver involved show recklessness or negligence at some point?
Once the investigation process is over and it proves that the motorist has caused the crash and neglected the safety of others on the road, the bicycle rider may be entitled to pursue a personal injury lawsuit seeking a compensation for all the hospital bills, future medical needs, lost wages and pain and suffering.
