Based on this news report, it appears that although the bicyclist did not have any lighting or reflective gear, the driver will likely still be held liable to a certain degree after hitting the victim from behind. Authorities will look into other factors, however, such as whether or not the driver under the influence of alcohol or drugs? Did excessive speed or distracted driving play a role? Was the driver negligent in any other way? Was the bicyclist riding in a bike lane? Was the bicyclist riding in the middle of the road? We trust officials are looking into these and other factors in order to determine precisely what occurred here to help figure out liability.
In such cases where negligence or wrongdoing may have been a factor, the bicyclist may be entitled to personal injury lawsuit against the driver pending the results of the investigation. If the driver is found responsible, the injured victim may seek compensation for damages including medical expenses and hospital bills and pain and suffering.
