Girl, 9, Seriously Hurt Bird Scooter Accident
SAN DIEGO, Calif. (Oct. 2, 2018) — A 9-year-old girl riding a Bird Scooter was seriously injured when she crashed the electric scooter on the sidewalk at 4200 Dwight Street, according to the San Diego County Sheriff’s Department.
The collision took place about 7:34 p.m. Monday night in the Castle neighborhood. Police say the girl’s 16-year-old sister was also on the scooter riding behind the 9-year-old girl who was operating the scooter on the sidewalk. When the teen fell off, the younger sibling lost control and struck a tree. The impact left the younger sister with a fractured femur. Paramedics rushed her to a hospital for treatment.
The incident is under investigation by police. It’s unknown at this time what caused the older sibling to fall off the bike or whether or not a dangerous road condition contributed to this collision.
Bird Scooter Accidents and Liability
Santa Monica-based Bird Rides Inc., a local dockless, scooter ride-share company, is one of several new companies giving pedestrians a cheap and fun ride to explore the San Diego area. Riders may be at risk of injury due to faulty equipment or falls due to uneven pavement.
These scooters may travel at speeds of up to 15 mph on sidewalks, boardwalks and streets in this area where they share walkways and roads with pedestrians, bicyclists and vehicles. Some problems riders could experience include faulty brakes or tires, abandoned scooters, collisions between pedestrians and scooter riders and car accidents. Many of the riders are also not wearing helmets or are under 18 years old when they rent the bike.
“Certainly falls or collisions involving scooters can result in fractured bones, head injuries, concussions and more,” said James Johnson, a San Diego injury attorney.
Although riders are required by the company to sign a waiver to assume the risk of injury, the waiver cannot protect the company from a gross negligence claim brought by an injured person, Johnson said.
