Based on the details provided so far from the report, it seems as though the driver will likely be held responsible for the collision as it is believed the victim, Earl Carey, was within the means of a marked crosswalk upon being struck. There are still many unanswered questions, however. Under California law, drivers who are approaching a pedestrian are required to exercise due care and reduce their speed for the safety of the pedestrian.
In such cases where negligence or wrongdoing may have been a factor, Earl Carey will likely be entitled to a personal injury lawsuit following this collision. Injured victims are entitled to compensation for damages including medical expenses, pain and suffering, and loss of income due to absence from work.
