Traffic Accident Investigation
At this time, we do not know who had the right-of-way in the roadway. There are also many unanswered questions such as whether or not the driver had a red light or if it had just gone green, was the pedestrian in the marked crosswalk or was speed alcohol or drugs a factor? Under California law, pedestrians always have the right-of-way in a crosswalk, however, they may not put themselves in harm’s way by darting out in front of a vehicle. If a pedestrian has not finished crossing a street when the light goes green the driver must yield to them and would be responsible if they were hit.
We offer our prayers to the family of the victim as they cope with this tragedy.
