If your loved one was involved in a fatal accident at work, and you were dependent on your loved one for support, you may be entitled to death benefits and may even potentially pursue a wrongful death claim if a third party was involved. Workers’ compensation creates liability of an employer to dependents of the deceased employee if it can be shown that the employee’s death was caused by a work-related injury or illness. Whether the fatal accident is work related depends on a number of factors, however, a fatal accident will be presumed to be work-related if the death occurred at or near the place of employment under circumstances suggesting that the employment caused the death.
