Jay Leno’s Law Changes the Rules for California Classic Cars—But There’s a Catch
If you own a classic car in California, there is some big news worth knowing about.
Gov. Gavin Newsom has signed Senate Bill 1392, known as “Jay Leno’s Law,” creating a phased-in smog-check exemption for qualifying collector vehicles from the 1976 through 1985 model years.
The law begins taking effect January 1, 2028, starting with qualifying vehicles from model years before 1981. Eligibility expands by one model year each year until 2033, when qualifying vehicles through the 1985 model year can be included.
But there is an important catch: These vehicles must be collector cars—not everyday transportation. Owners generally must demonstrate that the vehicle is covered by collector-car insurance or driven fewer than 1,000 miles per year.
Attorney James Johnson says classic-car owners should also remember that a smog exemption does not mean a safety exemption.
“Whether you’re driving a vintage Camaro, a lowrider, a classic Mercedes or an old pickup, the responsibility to keep that vehicle safe doesn’t disappear. Brakes, tires, steering, suspension, lights and other safety equipment need to be properly maintained.”
That matters from a personal injury standpoint. If a poorly maintained classic car is involved in a collision and a mechanical problem contributed to the crash, questions about maintenance, negligence and liability could become important in an injury claim.
The new law is designed for vehicles preserved and driven sparingly for events such as car shows, parades and historical exhibitions. It also recognizes the cultural significance of California’s classic-car and lowrider communities.
