Deadly Wrong-Way DUI Head-on Crash
DELHI (June 28, 2017)- According to the Merced-Sun Star, a fatal head-on collision caused by a drunk driver was reported Monday evening on Highway 99.
California Highway Patrol officials received notice regarding a fiery 3-car crash triggered by a wrong-way driver who had been traveling northbound on southbound Highway 99.
The driver of the Toyota Camry, Evan Garcia, was seen headed the opposite way of traffic traveling at high speeds before colliding with a Toyota Corolla followed by a Honda Civic.
The passenger inside Garcia’s vehicle, Jimmy Guerrero, sadly suffered fatal injuries and was pronounced at the scene.
Meanwhile, Kou Xiong, the driver of the Corolla, was significantly hurt with internal injuries to her midsection. She was rushed to Doctors Medical Center and remains in critical condition.
The driver of the Civic, Guillermo Benitez, was also injured but only to a minor degree.
Evan Garcia incurred serious injuries and was taken to the ER. He will be arrested on DUI charges once released from the hospital after being determined to have been under the influence.
Highway 99 has been considered one of the most dangerous streets to drive on in Merced County as there have been numerous fatal and major injury car accidents where alcohol has been a factor over the course of the past few years. It is imperative to proceed with caution and complete awareness of your surroundings especially in the late evening or early stages of the morning where there may be drunk drivers present. For this particular where there is clear negligence, the family of Mr. Jmmy Guerrero will be entitled to a wrongful death lawsuit against the at-fault driver, Evan Garica. Both Kou Xiong and Guillermo Benitez will have to right to a personal injury claim against Mr. Garcia as well. The family of Jimmy Guerrero and both injured victims may seek compensation for damages including medical expenses, funeral costs, lost future income and loss of love and companionship.
