As police investigate the facts and evidence surrounding this collision, it appears that based on the news reports about this tragedy that this driver will be liable for the injuries of these family members and the wrongful death of the mother. A driver who drinks and disregards the safety of other people will likely face criminal charges such as vehicular manslaughter with gross negligence. If the driver has previous drunk driving convictions, they may also face murder charges if someone dies in a crash.
