Kristil Kincaid and Unborn Child Killed in Hemet DUI Crash on Warren Road
HEMET (September 10, 2018) – A pregnant woman was killed after an alleged DUI crash along Warren Road on Sunday night, according to Riverside County News Source and The Press Enterprise.
Family members and friends have identified the victim as 29-year-old, Kristil Kincaid, of San Jacinto. Her unborn child also died in the wreck.
As per the reports, police said a blue BMW was allegedly traveling at a high rate of speed south on Warren Road when it swerved into the northbound lanes.
The driver of the speeding car, 28-year-old Marcos A. Forestal, then collided head-on with the silver Chrysler driven by Kincaid. The Chrysler immediately caught fire upon impact.
Suspect Marcos Forestal Arrested For DUI
Police affirmed that Kincaid was extricated from the wreckage and was flown to Riverside University Medical Center in Moreno Valley where she and her unborn baby were pronounced dead.
The accident occurred on September 9 at about 8:30 p.m. in the 500 block of Warren Road, just north of Devonshire Avenue. A GoFundMe page has been created to help Kincaid’s family and her funeral expenses.
Meanwhile Forestal, who was believed to have been drunk at the time of the collision, was found walking near his vehicle while filming with his cell phone. The Burbank man was treated for minor wounds at an area hospital and was later arrested.
The suspect was booked into the Smith Correctional Facility in Banning on suspicion of felony DUI resulting in injuries, and may face vehicular manslaughter charges upon the death of the victims.
We offer our prayers and most heartfelt condolences to the family members and friends of Ms. Kristil Kincaid during such a difficult time.
Riverside County Wrongful Death Lawyer
It is evident that Mr. Marcos Forestal will be held fully responsible for causing the incident that led to the death of the pregnant woman and her unborn baby. The motorist is believed to have been driving under the influence of alcohol when the collision occurred. DUI is considered a serious crime throughout the state, especially if the incident tragically killed other individuals.
Aside from DUI, the suspect is also accused of speeding and neglecting the other motorist by filming the incident instead of rendering aid to the injured party. In such cases where negligence and wrongdoing are clearly factors, the surviving family of Ms. Kristil Kincaid will then have the right to pursue a wrongful death lawsuit against the suspect. Family members of wrongful death victims will be entitled to a recompense for the funeral costs, hospital bills, loss of future income, and loss of love and companionship.
