It is necessary that certain precautionary measures shall be put into action by the motorists, taking into consideration the other people such as the pedestrians who are also in the roadway. The increase of pedestrian accidents, whether they result in injury or death, is both alarming and distressing, as they threaten the safety of the individuals on the road. Aside from factors such as alcohol or drugs, excessive speed and distracted driving, inadequate law enforcement and poor road design and construction may also play a role in the occurrence of such incidents.
Once the investigation process is over and it proves that a negligent person has caused the incident and led to the injuries of the pedestrian, the victim may have the right to pursue a personal injury lawsuit against the at-fault individual or entity. The claim will include the compensation for all the hospital bills, future medical needs, and pain and suffering.
