Suspected Hit-and-run Driver Arrested Charged with Vehicular Manslaughter
WASCO, Calif. (Feb. 9, 2018)- Noe Bryan Martinez, 22, of Wasco, has been arrested following a collision where he struck and killed a bicyclist Thursday afternoon and then fled the scene, according to a report by the Bakersfield Californian.
The suspect is being held in lieu of $70,000 bail and faces charges of vehicular manslaughter with gross negligence and hit-and-run resulting in an injury. His next hearing is scheduled for 9 a.m. on Tuesday, Feb. 13th at the North Division, Delano, division/department Z., according to Kern County Sheriff’s Department records.
The fatal crash took place about 2:30 p.m. on Feb. 8 at Palm Avenue north of Gromer Avenue, according to the California Highway Patrol.
Police contend that Martinez was driving northbound on Palm Avenue at a speed upwards of 80 mph when he passed a Honda at the intersection with Gromer Avenue. The bicyclist was riding south on Palm Avenue near the center of the road when they were struck by his vehicle.
Kern County Wrongful Death Lawyer
An investigation into this collision is underway and criminal charges have been filed against the suspect, but the family of a victim killed in a crash may also file a separate civil lawsuit. If a negligent driver caused a collision that left you with injuries or the loss of a loved one, you may have grounds for a personal injury or wrongful death claim.
It’s important to note, however, that it’s quite common for insurance companies to try and avoid paying out a claim even when they know their insured is responsible. They may also make an offer to settle for far less than the full amount owed. This is unacceptable.
