Based on the news report, a motorist involved was apparently distracted while traversing the road. Authorities will continue to investigate the collision, and will determine whether or not alcohol or drugs also played a role, whether or not the motorist was speeding prior to impact or did not yield to the right-of-way individual and whether or not the party who allegedly prompted the crash was driving recklessly at some point.
In such cases where negligence may have been a factor, the injured and held not liable for causing the wreck has likely a right to pursue a personal injury lawsuit against the at-fault individual. The claim will include a compensation for all the hospital bills, future medical needs, lost wages, and pain and suffering.
