OAKLAND, Calif. (May 31, 2018) — A 67-year-old man in a mobility scooter was struck by a big rig truck and injured Wednesday as he tried to cross an intersection in West Oakland, according to the San Jose Mercury News.
The collision took place about 12:18 p.m. at 14th and Brush streets. As the man rode his scooter eastbound across Brush Street, he was struck by the semi-tractor trailer truck that was hauling an end-dump trailer. The victim, who lived in the area, was hospitalized after suffering undisclosed injuries.
The truck driver initially told police he had the green light. The scooter was wedged in the front grill of the truck after the collision and the man riding it was thrown onto the roadway.
Oakland Accident Investigation
Police are investigating this collision to determine liability. At this time, it appears that the man riding the scooter was in a marked crosswalk, but we do not know if the truck driver had the green light or not. However, under California traffic laws, all motorists must yield the right-of-way to pedestrians who are in the roadway. A driver must wait until a pedestrian has finished crossing the street before approaching the intesection.
If a negligent driver or another entity is at fault for a collision resulting in injuries to you or a loved one, there may be grounds for a personal injury or wrongful death claim. While this is always a personal decision, for many the financial losses associated with a traffic accident are significant.
