Santa Barbara County Personal Injury Lawyer
California has several right of way laws that apply to the pedestrians. These laws include the obligation of the drivers to exercise due care and lessen the speed of their cars while approaching a pedestrian within any marked or unmarked crosswalk.
In this case, authorities are investigating several factors such as alcohol or drugs, excessive speed and distracted driving to determine the liability in the incident.
Once the investigation process is over and it proves that the motorist has been negligent, the family members of the young pedestrian may have the right to pursue a personal injury lawsuit seeking compensation for all the hospital bills, future medical needs, lost wages and pain and suffering.
