In this case, there are several questions that need to be resolved in order to determine the liability in the crash. Was the driving under the influence of alcohol or drugs a factor? Did excessive speed or distracted driving play a role? Did the motorist who drove over the center median show recklessness or negligence at some point?
Once the investigation is over and it proves that a negligent party has disregarded the safety of other people on the road, the injured and held not responsible for the collision may have the right to pursue a personal injury lawsuit seeking compensation for all the hospital bills, future medical needs and lost income.
