Based on the details provided so far from the report, there are still many unanswered questions that will be addressed pending the investigation. California laws read that any driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

A forensic examination of both the vehicle and the pedestrian, as well as photos that were taken of the scene, will help investigators determine which party ultimately caused the accident. Other potential factors will be looked into as well including whether or not either the driver or the victim were under the influence at the time of the accident? Was the driver driving recklessly or over the speed limit prior to impact? What were the road conditions and how was the lighting in the vicinity of where the accident occurred? was the victim crossing an intersection in a marked crosswalk or designated crossing area or was he jaywalking across the road? Each of these factors will be assessed allowing police officials to draw up a final conclusion.
