Fatal Pedestrian Accident Santa Clara Street Under Investigation
SAN JOSE, Calif. (May 30, 2018) — Samuil Shakman, 77, of San Jose, was struck and killed Tuesday night as he walked across Santa Clara Street in downtown San Jose, according to the San Jose Mercury News and the Santa Clara County Medical Examiner-Coroner’s Office.
The collision took place about 8:46 p.m. last night near 11th Street. The victim was walking eastbound across Santa Clara when a man driving a 2004 BMW 330 CI headed northbound on 11th Street struck him.
Paramedics responded and rushed the injured man to a hospital, but unfortunately he died of his injuries shortly after.
Police noted that this was the city’s 19th traffic fatality of the year and this is the eighth pedestrian fatality in 2018.
The driver was questioned by police at the scene and they do not suspect drugs and or alcohol were factors.

Fatal Accident Investigation
Police are investigating this collision to determine the cause and liability. At this point, police do not know who had the right-of-way at the intersection. Typically, under California law, drivers must always yield to a pedestrian. However, pedestrians must also not put themselves in harm’s way.
