Wrongful Death Lawyer
California has several right of way laws that apply to the pedestrians. These laws include the obligation of the drivers to exercise due care and lessen the speed of their cars while approaching a pedestrian within any marked or unmarked crosswalk.
In this case, authorities are investigating several factors such as alcohol or drugs, excessive speed and distracted driving to determine the liability in the tragic incident. Once the investigation process is over and it proves that the motorist involved has been negligent, the surviving family of the elderly man may have the right to pursue a wrongful death lawsuit against the at-fault party. The claim will include a recompense for the funeral costs, hospital bills, loss of future income, and loss of love and companionship.
