A forensic examination of the bicycle and the SUV, as well as photos that were taken of the scene, will help investigators determine what ultimately caused the crash. Authorities will thoroughly look into the speed of each party, whether or not alcohol or drugs played a role, whether or not there were any mechanical issues with the bike and the car, and whether or not one of the individuals involved was distracted or simply did not yield to the right of way person. The investigation will also consist of looking at measurements of evidence left by the bicycle and the vehicle, such as point of impact, their final resting positions, skid marks, and gouge marks.
Pending the result and findings of the investigation, San Jose Mayor Sam Liccardo may possess the right to pursue a personal injury lawsuit, seeking a compensation for all the hospital bills, future medical needs, lost income and pain and suffering.
