San Jose Accident Investigation
An investigation into this collision is underway to determine who is at fault. Typically, a pedestrian has the right-of-way in the roadway, even outside of a marked crosswalk. A driver is supposed to yield the right-of-way and should not be driving above the speed limit.
If a negligent driver is at fault for a collision that left you injured or caused the death of a loved one, there may be grounds for a civil lawsuit or wrongful death claim. This is always a personal decision, but for many the financial losses associated with a traffic accident can be significant.
It’s important to note, however, that it’s quite common for insurance companies to try and avoid paying out a claim even when they know their insured is responsible. They may also make an offer to settle for far less than the full amount owed.
