CALIFORNIA — It may seem harmless to serve a batch of spiked witch’s brew to underage guests at your teenager’s party on Halloween, but if they hurt someone on their way home you can be held responsible.
Indeed, social host liability laws in California make it the legal responsibility of hosts to refrain from serving minors alcohol and or marijuana at a party.
This means if an impaired underage party guest drives home and hurts themselves or someone else, you can be held responsible for the resulting injuries or damages.

Furthermore, it’s not a defense to say the guest wore a costume or makeup. If there is any question about someone’s age, it’s best to be safe and refrain from serving alcohol in parties where young guests may consume it.
