In this case, there are several questions that need to be resolved in order to determine the liability in the crash. Was the driving under the influence of alcohol or drugs a factor? Did excessive speed or distracted driving play a role? Why did the operator of the Volvo veer into the opposite lane? Was there any mechanical issue with the Volvo? Was the driver of that tractor-trailer reckless or negligent at some point?
Pending the results and findings of the investigation for this accident, the injured and not held responsible for causing the collision will possess the right to pursue a personal injury lawsuit against the at-fault party.
