Pedestrian Hit by Car at Santa Monica and Vermont; Gankuyag Nyamdorj Arrested
LOS ANGELES, Calif. (Dec. 31, 2018) – Timothy Martinez, 31, was struck and killed early this morning in the East Hollywood area of Los Angeles, police said.
The collision took place about 2:24 a.m. at Santa Monica Boulevard and Vermont Avenue, police said.
Paramedics and police responded to the scene, but unfortunately, the pedestrian died before they could be taken to the hospital, the coroner’s office said.
The driver of the Lexus who struck the pedestrian was identified as Gankuyag Nyamdorj. Police believe Nyamdorj was under the influence of alcohol at the time of the crash and subsequently arrested Nyamdorj on suspicion of gross vehicular manslaughter while intoxicated. He was later released from jail on $100,000 bail.

Liability for Pedestrian Accidents
Typically, under California law, pedestrians have the right-of-way in the roadway. Drivers must yield to them by slowing down or stopping, however, there are times when a collision is unavoidable such as if a pedestrian darts out in front of the vehicle. We do not know what led to this collision, but police are piecing together evidence and will speak to any witnesses to find out.

At this time, it’s unknown what caused this collision. Police are investigating the circumstances and will determine liability.
