CAL FIRE/Riverside County Firefighters responded to the scene where they found a male toddler who nearly drowned and rushed him by ambulance to a local hospital. He was later listed in stable condition, the report said.
Prior Near Drowning at Marriott Shadow Ridge Resort
The incident is not the first to take place at this hotel’s swimming pool. A 3-year-old was pulled unconscious from the main pool at the resort in August 2014, according to the Patch. The toddler boy was resuscitated by a firefighter who happened to be on vacation there and taken to hospital in stable condition by arriving paramedics.
Liability for Drownings
There are situations where a premises liability claim can be made against the operator of a swimming pool where a child has drowned or nearly drowned. An attorney will want to find out if there was a dangerous condition involved. Legal questions would include, was there a lifeguard on duty, proper signage installed, was the pool properly maintained or was it cloudy and difficult to see the bottom? Who was supervising the child at the pool? Was there unsafe drain suction that held the child under water?
