At this time, we do not know what led to this crash or who is liable. There are many unanswered questions including whether or not the truck driver was following strict trucking regulations as required by California law? Were there distractions involved? A person who has suffered injuries in a collision due to a negligent driver may file a claim to recoup financial losses stemming from a traffic accident.
Police will ultimately decide whether or not criminal charges should also be filed against a driver who is responsible. It’s not always so easy, however, to negotiate a fair settlement even when it’s clear you are not at fault. Indeed, the adjusters will do everything they can to minimize your losses and get you to settle for less than what you are owed. The adjusters may also try to blame the victim or hold them partially responsible for what happened.
